Wharfside Gym – Membership Terms and Conditions

These Terms and Conditions (“Terms”) form the legally binding agreement between you (the “Member”) and Wharfside Gym (“we”, “us”, or “our”) regarding your membership and use of our facilities, services, and programs.

Please read these Terms carefully before signing up. By signing the agreement or ticking the consent box online, you confirm your understanding and acceptance of these Terms.


1. Membership Eligibility and Application

1.1. Membership is available to individuals aged 16 years or older. Individuals aged 16 or 17 must obtain written consent from a parent or guardian.
1.2. We reserve the right to decline a membership application at our discretion, with or without providing a reason.
1.3. By applying for membership, you confirm that all personal information provided is true, accurate, and current.


2. Membership Types and Access

2.1. Membership types and access levels (e.g. Full Access, Off-Peak, Classes Only) will be detailed in your Membership Agreement.
2.2. Access to the gym is only permitted during our designated hours, which may vary by location and public holidays.
2.3. Any misuse of access privileges, including allowing non-members to enter using your credentials, may result in immediate termination without refund.


3. Membership Fees and Payments

3.1. Membership fees are payable in advance via direct debit, card payment, or another approved method.
3.2. Monthly fees are charged on the 1st of each month unless you have chosen a different payment date .
3.3. Failed payments may result in late fees, suspension of access, and referral to a collections agency.
3.4. We may adjust membership pricing with a minimum of 30 days’ written notice. Continued use of the gym after this period will constitute acceptance of the new pricing.


4. Cooling-Off Period

4.1. You have the right to cancel your membership within 14 calendar days of your start date without penalty if you have joined the club online and not visited the club before . This is removed after your first visit
4.2. If you use the facilities during this period, a pro-rata fee may be deducted from any refund.


5. Health and Safety

5.1. You confirm that you are in good health and are not aware of any medical condition that would prevent you from safely using gym equipment or participating in physical activity.
5.2. You agree to consult a doctor prior to beginning a fitness regime if you are unsure of your suitability.
5.3. You must follow all safety guidelines, including posted signs, equipment instructions, and directions from staff.
5.4. You must not use the gym under the influence of alcohol, drugs, or any medication that could impair your judgment or physical ability. If we believe you to be under the influence of any substance , you may be asked to leave immediately for your own and other members safety


6. Code of Conduct

6.1. You agree to treat staff and other members with respect and courtesy at all times.
6.2. Aggressive, abusive, discriminatory, or threatening behaviour will not be tolerated and may result in immediate expulsion.
6.3. Proper gym attire (e.g. closed-toe shoes, shirt, and athletic wear) must be worn at all times.
6.4. Equipment must be wiped down after use. We reserve the right to enforce hygiene rules. We require members to bring a small hand towel with them each visit
6.5. Mobile phone use is not permitted in workout areas if it causes disruption or invades the privacy of others. If another member appears in the background of any video that you intend to upload to social media ,you must ask their permission before doing so


7. Classes and Booking Policy

7.1. Group fitness classes require advance booking and are subject to availability.
7.2. Late arrivals may not be admitted for safety reasons.
7.3. Cancellations should be made at least [e.g. 4 hours] prior to the class start time. Repeated no-shows may result in booking restrictions or fees.
7.4. We reserve the right to cancel or reschedule classes due to low attendance, instructor illness, or operational needs.


8. Freezes and Terminations

8.1. You may request to suspend your membership (e.g. for medical reasons or travel) for a period of up to 3 months per year. Supporting documentation may be required. A freeze Charge of £5 per month is charged for each month on Freeze. Your final month cannot be a frozen month. ie your final month has to be a fully paid month 
8.2. We reserve the right to suspend or terminate your membership immediately if you breach these Terms or act in a way that endangers others or the reputation of Wharfside Gym.
8.3. No refund will be provided for terminations due to misconduct or breach of contract.


9. Cancellation and Refunds

9.1. No Long Term Commitment Memberships .You may cancel your membership at any time by providing a minimum of 30 days written notice from your next billing date . This means that if you request cancellation on the 15th July and your billing date is the 27th July, Then the 27th July would be your final billing date and your membership would end on the 26th August

9.2. Early termination of fixed-term contracts will incur a cancellation fee unless due to medical grounds (with supporting documentation)or relocating more than 5 miles from the club 

9.3. Refunds will only be given in line with our refund policy or where required by law.


10. Facilities and Equipment

10.1. We strive to keep all equipment and facilities in good working order but cannot guarantee that all equipment will be operational at all times.
10.2. Temporary closures for maintenance, cleaning, or safety reasons may occur without refund.
10.3. You must not misuse equipment or tamper with fire alarms, emergency exits, or security systems.


11. Lockers and Personal Belongings

11.1. Lockers are provided for day use only unless otherwise specified. Overnight storage is not permitted.
11.2. We are not responsible for lost, stolen, or damaged personal belongings.
11.3. Items left in lockers overnight may be removed and stored for a maximum of 7 days before disposal.


12. Data Protection and CCTV

12.1. We process your personal data in accordance with UK GDPR and our Privacy Policy, available on our website.
12.2. CCTV is in operation for safety, security, and monitoring purposes. Video footage may be shared with law enforcement if necessary.


13. Liability

13.1. You acknowledge that using gym facilities involves a risk of injury. You voluntarily accept full responsibility for all risks associated with participation.
13.2. We will not be liable for death or personal injury unless caused by proven negligence on our part.
13.3. To the maximum extent permitted by law, we disclaim liability for indirect, incidental, or consequential losses.


14. Changes to Terms

14.1. We may update these Terms occasionally. Members will be notified in writing at least 30 days in advance of any material changes.
14.2. Continued use of the facilities after this period constitutes acceptance of the revised Terms.


15. Governing Law

These Terms are governed by and construed in accordance with the laws of [England and Wales / Scotland / Northern Ireland], and any disputes will be subject to the exclusive jurisdiction of the courts of that territory.
